Albany new bill allows re-sentencing for eligible prisoners

State Assemblywoman, Latrice Walker, , has introduced a bill to grant eligible prisoners the chance for re-sentencing.

According to a report on Wednesday, Walker has has also received the support of state senator and fellow Brooklyn lawmaker Julia Salazar.

The bill would allow incarcerated people in Albany who have served more than 10 years or 50% of their sentence to petition for re-sentencing, the report says.

Those eligible would also have to show that they have used prison as a form of rehabilitation and self-improvement.

A motion for re-sentencing is brought by a person who has already been convicted and sentenced for a crime, and who is now asking the court to reduce or modify the sentence.

The motion typically seeks to reduce jail or prison time to allow the defendant to be released from custody, or to relax the conditions of probation.

A prisoner can file this petition no matter if he was sentenced for a misdemeanor or a felony.
